The Fair Credit Reporting Act Dispute Process/Timeline

How it works

  • Obtain your credit reports. 
    • www.annualcreditreport.com offers free weekly credit reports from the three major reporting agencies (Equifax, Experian, and Trans Union). You can pull these and print them to PDF prior to a consult with Tim, or he will walk you through the process and obtain them with you during your initial consult.
  • Analyze the reports
    • Tim will go over the reports with you and then further analyze them for inaccuracies. The FCRA demands that information on credit reports is complete and accurate. If information is incomplete or inaccurate it gets included in the Dispute Letter.
  • Prior to initiating a lawsuit, a Dispute Letter must be sent to the credit reporting agencies. 
    • This letter simply identifies yourself and lists the inaccuracies included in your reports. The FCRA mandates that the agencies have 30 days to respond to you about your dispute. 
  • If the agency's response does not fix the inaccurate information, or they simply do not respond within 30 days, a lawsuit is initiated.
